A state appellate court has overturned the conviction and dismissed the indictment of insurance agent Norman Michaels in a case involving coverage provided through the Otsego County Chamber of Commerce. In a decision made about two weeks ago, the state Supreme Court, Appellate Division, Third Judicial Department, decided on Michaels' appeal, citing a lack of legally sufficient evidence in the case. The four-judge panel reversed a 2014, jury conviction of Michaels on charges of grand larceny and scheme to defraud and dismissed the indictment. Michaels and Rob Robinson, former Chamber president, had been accused of fraud involving the sale of MVP Health Insurance coverage years ago. Last year in Otsego County Court, Robinson plead guilty to first-degree scheme to defraud and was sentenced to a three-year conditional discharge and fined $2,000.
